General Terms and Conditions
1. GENERAL INFORMATION
The online shop for the sale of tickets and merchandise www.proticket.si is operated by Proevent d.o.o., VAT ID number: SI68557027, registration number: 5879264 (hereinafter referred to as the Seller or Proevent).
Proevent(https://proticket.si/) provides support for the smooth operation of the online shop and sales. Sensitive data is transmitted over a secure socket layer(SSL) connection, which enables secure online shopping.
Credit and debit card payments are made via Stripe. The smooth operation of the system is made possible by Stripe Inc.
The customer does not need a username and password to make online purchases. The only information required to make a purchase is the buyer’s email address, bank card details and the payer’s details.
If the customer opts in to receive email notifications when making a purchase, the email address is also used to send messages about new related events and tickets. The Buyer is responsible for the accuracy of the personal and other information entered at the time of purchase.
Proevent is also a ticketing partner for other events.
In case of suspected abuse, the Customer is obliged to immediately notify Proevent by e-mail to info@proticket.si or by telephone on 01 300 32 24.
The data obtained is used by Proevent exclusively for its own purposes. More in section Privacy Statement.
These General Terms and Conditions have the nature of a contract. The Buyer shall be bound by the General Terms and Conditions in force at the time of purchase (placing an online order). The Buyer shall be specifically reminded of the General Terms and Conditions at the time of placing the order and shall confirm his/her awareness of them by placing the order. The Seller reserves the right to modify the General Terms and Conditions, but the General Terms and Conditions as published at the time of purchase shall apply to the relationship between the Seller and the Buyer. The competent court in Ljubljana shall have jurisdiction to settle any disputes.
AVAILABILITY OF INFORMATION BEFORE PURCHASE (OR CONCLUSION OF A CONTRACT)
The Seller undertakes to provide the Buyer with the following information before the Buyer is bound by the Contract or the Offer:
– details of the event (name and registered office, registration and tax number, address at which the seller is established and, where applicable, the name and registered office of the company on whose behalf the seller sells tickets or goods and to whom the buyer can address his/her complaint),
– contact details that allow the customer to communicate quickly and efficiently (email, phone),
– the main features of the product,
– the final price of the product, including taxes, or the way the price is calculated if it cannot be calculated in advance due to the nature of the product,
– the terms of payment or performance of the service, the time limit for delivery of the service, where applicable,
– information about the seller’s complaints procedure,
– the conditions, time limits and procedure for exercising the right to withdraw from the contract without giving a reason in accordance with Articles 43c and 43d of the Consumer Protection Act (CPA); if the consumer does not have the right to withdraw in accordance with Article 43c of the CPA, he or she is expressly informed thereof),
– the out-of-court dispute resolution and other remedies available at Proevent and their availability.
MEANS OF PAYMENT
The means of payment are:
– credit and debit cards supported by Stripe Inc. (Eurocard/Mastercard, American Express, Diner’s, Visa); the payer (customer account details) must be the same person as the debit or credit card holder;
– direct bank transfer (if available for the specific event); the buyer receives the transfer details when placing the order, the purchase is valid and the tickets are sent to the buyer’s email address only after the transfer has been made (usually within one (1) working day of the transfer).
Means of payment and methods of delivery are determined during the purchase process.
When paying by credit card, in addition to the basic card details (card number, validity and CVC code), other information required by the bank must be entered during the payment process.
For credit/debit card payments, the payment process takes place on the bank’s website. All payment conditions and security protocol are set and implemented by the bank.
OUT-OF-COURT SETTLEMENT OF CONSUMER DISPUTES
In accordance with the Law on Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC:
– we declare that we do not recognise any out-of-court consumer dispute resolution provider as competent to resolve a consumer dispute that a consumer may bring under the Act on Out-of-Court Settlement of Consumer Disputes.
2. PURCHASE OF TICKETS
Tickets for Proevent events can only be purchased online in the online shop(proticket.si). There are no other providers or intermediaries for purchasing tickets.
Purchase receipts and tickets (“print at home” tickets) are stored in a PDF file, which requires at least Adobe Reader 7.0 on your computer.
When you buy online at https://proticket.si, we offer a discount for a certain period of time during certain promotions. The discount is calculated when the discount code (or promotion) is entered.
PURCHASE BALANCE AND TICKETS
You will receive a confirmation of your successful purchase to the email address provided at the time of purchase, showing the status of the tickets (number, date and location of the event) and the purchase.
ADMISSION TO THE EVENT (TICKETS PURCHASED ONLINE)
Entry to the event is possible with a home-printed or electronic ticket stored on a mobile phone or other portable device. We do not accept a photo of the ticket or a photo of the device with the ticket as an admission ticket.
When you buy tickets for an event, you will receive a receipt and the ticket(s) to the email address of the payer. You can print the ticket or save it on your mobile phone.
Tickets purchased cannot be returned or refunded.
TICKET SECURITY
Tickets may not be misused, copied or altered. It is the responsibility of the Purchaser to protect the Tickets purchased and to prevent any misuse that may occur if they allow third parties access to the Ticket or QR Code. Each ticket is valid for the first entry to the event, which means that no further entries with the same ticket will be possible. By using an authorised ticket, the user accepts the general terms and conditions and the rules of the event organiser.
ERRORS DURING PURCHASE
If the browser sends an error message during the purchase or if other obvious problems occur during the purchase, the customer should first check the transaction balance in his/her own bank or account before trying again. If the receipt for the desired event is not displayed, the transaction has not been completed. If the purchase is listed in the transactions section of the online bank, the transaction has been successful. APPEAL PROCEDURE
The complaint may be submitted in writing to the e-mail address info@proticket.si (you will receive a confirmation of receipt of the message upon sending) or by registered letter to Proevent d.o.o., Dunajska cesta 10, 1000 Ljubljana. The complaint must contain the contact information of the complainant and a detailed description of the grounds for the complaint. The complaint must be submitted no later than eight days before the event.
Within eight days of receipt of the complaint, the proevent or event organiser must provide the complainant with a written or oral response to the complaint.
ONLINE TICKET PURCHASE IS FINAL
Before clicking on Buy Now, the buyer is obliged to carefully check all the details of the purchase (date and amount of purchase, name of the event, number of tickets, etc.). He/she can still change the number of tickets in the last box before payment. Once the tickets have been purchased, which in the case of online purchases is done directly after clicking on the Buy Now button, no changes or cancellations can be made.
According to Article 43(5)(12) of the PSPOA, the consumer does not have the right to withdraw from the contract in the case of leisure services where the undertaking undertakes to fulfil its obligations on a specific date or within a specific time limit, unless the parties agree otherwise in the contract. In view of the above-mentioned statutory exception, all ticket orders are binding, regardless of the method of ordering (online shop or point of sale, at the event box office). Tickets for all events in Slovenia and abroad purchased via the Proevent online portal or its authorised sales outlets cannot be returned and are non-refundable.
In the event of lost or stolen tickets, the purchaser is not entitled to reimbursement, replacement or replacement tickets. The loss, theft or destruction of a ticket must be reported to the Seller as soon as possible.
Tickets can only be purchased in the online shop by natural persons. If you wish to make a purchase for a legal entity, please contact us by email at info@proticket.si or call us on 01 300 32 11 during office hours (8.30-15.00 every weekday).
Tickets can also be purchased at the event on site.
For the purpose of the delivery of tickets to legal entities (fulfilment of the contractual obligation), the Buyer shall provide the Seller with the delivery address, telephone number and e-mail address.
GOODS PRICES
All prices include VAT, which is applicable to the service. Prices are valid at the time of order placement and have no predefined validity. Despite our best efforts to provide the most up-to-date and accurate information, it is possible that a price may be incorrect. In this case, or if the price of the item changes during the processing of the order, Proevent will allow the Customer to withdraw from the purchase.
PROCUREMENT PROCEDURE
Tickets are selected and ordered from the ticket list at https://proticket.si. The buyer selects the desired item by clicking on the Buy Ticket button.
Before the order is placed, a draft of the order is displayed, ready for submission, so that the customer has the opportunity to check the correctness of the data entered or to identify any errors and to correct or modify the data related to the order (quantity and type of products, method and place of delivery and method of payment).
By clicking on the “Buy Now” button, the Buyer declares that he/she fully understands and agrees to the General Terms and Conditions. If the order is successfully completed, a confirmation text will be displayed on the website.
After placing the order, the customer receives an e-mail notification that the order has been accepted.
Proevent may call the customer’s telephone number to verify the information or to ensure the accuracy of the delivery.
TICKET OFFER
Due to the nature of the online business, the ticket offer is constantly updated. Smaller quantities are available. For orders of larger quantities (ten or more), please contact us at info@proticket.si.
CANCELLATION OF THE EVENT
In the event of cancellation or change of date, Proevent d.o.o. is responsible for arranging the situation and refunding the money.
If an event is cancelled or postponed, you can use your tickets for a new event date or we will refund your money, no later than one month after the scheduled event date. Tickets returned or unused afterwards are non-refundable and cannot be exchanged for another event. The value of a ticket transferred to a new event date remains the same.
Ticket holders who have paid with payment services that allow refunds to be made to the same means of payment will receive a refund in the same way as they made the payment. The refund of the purchase price shall invalidate the tickets, regardless of the format.
In the event of cancellation, change of event date or change of line-up or programme, any additional costs you may incur (e.g. travel, hotel, point of sale, delivery costs) will not be reimbursed.
Proevent informs about the changes on its website and in the public media and social networks.
REFUND OF PURCHASE PRICE DUE TO FORCE MAJEURE (E.G. NEW CORONAVIRUS EPIDEMIC)
For events postponed or cancelled due to force majeure, which includes the outbreak of Candid 19 (the new coronavirus), Proevent will refund ticket purchasers in one of the following ways.
Ticket refunds for postponed or cancelled events
Proevent is working to find a new date for the cancelled events. Proevent keeps you informed about new dates, as well as which events are cancelled and for which a new date is not guaranteed, on Proevent’s website and social media channels, and in the newsletter. Tickets purchased for postponed events are valid for the alternative dates and do not need to be exchanged (unless otherwise stated).
If the new date is not convenient for visitors or the event is cancelled, Proevent will issue a credit note for the ticket price or refund the purchase price. The credit note or refund request must be settled by the date of the new date of the rescheduled event. The credit note shall be valid at least until the new date of the rescheduled event.
In the case of a positive test for the covid-19 virus, which is valid under current legislation, the organiser offers the possibility of a refund or credit for the first subsequent event (at the buyer’s choice). The refund conditions are the same as in the case of cancellation of the event due to force majeure.
Claims for refund or credit
Proevent will arrange the issue of a credit note or refund within 30 days of receipt of a written request for a refund. Ticket purchasers can arrange the claim at Proevent’s head office during opening hours or remotely. Remotely by sending the e-ticket, a photo or scan of the e-ticket and the TRR transfer details to info@proticket.si.
ISSUANCE OF THE ACCOUNT
Proevent d.o.o. sends an invoice in pdf format to the customer’s e-mail address after the ordered items have been dispatched. The invoice shall contain a breakdown of the price and the costs related to the purchase. The Buyer is obliged to verify the accuracy of the information on the invoice and inform the Seller of any errors within eight days of receipt by e-mail to info@proticket.si or 01 300 32 24. Subsequent complaints regarding the correctness of the invoices issued will not be taken into account by Proevent.
3. PRIVACY STATEMENT AND COOKIES
We handle personal data responsibly, carefully and in accordance with the regulations in force in the Republic of Slovenia and the European Union, as well as with our internal regulations. Access to personal data is permitted only to authorised employees and contractual processors, to the extent and for the purpose strictly necessary for the smooth performance of work processes, the provision of services and the fulfilment of rights and obligations under contractual relations concluded with the client. COLLECTION OF PERSONAL DATA
Personal data is collected when you pay for your festival tickets online.
The personal data we collect includes your name, contact and payer information and email address for the delivery of e-tickets. In the case of legal persons, also the name of the company or organisation with the related data (address, tax number, responsible person), e-mail address, telephone contact.
This website may also collect information about your visit, such as the name of the internet service provider and the IP address from which you access the internet; the date and time of access to the website; the addresses of the websites you access while you are on this website and the internet address of the website from which you come directly to our website. This information is collected for the purpose of improving the website, analysing guidelines and administration and is stored for the purpose of managing transactions.
PURPOSE OF USE OF PERSONAL DATA
The personal data collected through online sales is used for the operation of the Site and to provide the services or carry out the transactions you request or consent to.
The Seller uses your personal data to:
– fulfil the order or contractual obligation (sending materials, tenders, invoices – all related to the order) and other related and necessary communications,
– provide better and more efficient assistance to customers,
– improve online sales, service offerings and keep up with developments in information technology,
– make the site more user-friendly by implementing the latest online trading tools,
– informs you of important information about new products on sale and notices from the organisers;
– information about visits to the website is used for research purposes, such as to calculate statistics using the Google Analytics web tool.
If you sign up for the newsletter when you register in the online portal of the retailer, the retailer uses technology that tells you that you have clicked on the link provided in the email. We may combine this information with your personal data in order to provide you with more specialised emails or information shared with an external provider for sending mass emails. Each email contains a link that allows you to opt-out of receiving such emails.
USE OF COOKIES AND TYPES OF PERSONAL DATA
When you visit a website for the first time, a cookie is placed on your computer (if your browser is set to accept them); if you have already visited the website, the cookie placed on your computer is read by the web server. One of the purposes of using cookies is to collect the website traffic statistics described above. Cookies cannot be used to run programs or to transmit viruses to your computer. They are also used to collect information about which web links a user visits. We use this information to determine whether we are really sending customers the information they want to read. We collect it in aggregate form and do not link it to your personal information.
Proevent collects the following information about the user:
– IP address, browser version(user agent), time, address of the visited page (URL), page from which the user arrives at the visited page(referrer) – if this information is provided (the information is logged in the log of that day when the user takes action);
– the information provided by the user in his/her profile (name, address, place, post, country – mandatory, mobile phone, telephone);
– event view data to ensure the functionality of the tagging of read content, topic tag, unique user tag, time of view (data is stored for up to one year after the event; periodically, all but the last topic view data is deleted).
Proevent assigns asession cookie to the user at the start of the session to personalise the user experience. The data is stored until the user closes the browser.
Proevent assigns apersistent cookie to the user to uniquely identify them when they log in automatically. The data is stored permanently or until the user deletes the cookie from the browser or turns off the automatic login in his/her profile.
Proevent uses Google Analytics to keep statistics on website traffic.
PROTECTION OF PERSONAL DATA
Proevent does not disclose personal data to unauthorised third parties. It may disclose personal data to its contractual processors or under a legal obligation to do so, in accordance with the applicable regulations governing the protection of personal data.
Data may be shared:
– data processing and IT services companies that ensure the smooth operation of the web portal and its improvements (server hosting, e-marketing, etc.),
– companies that ensure a smooth purchasing process (Stripe Inc.), but only to the extent necessary for the successful execution of the order,
– to authorised bodies if required by law (such as a court).
All partners who have access to personal data are obliged to handle it carefully and in accordance with applicable law.
Proevent uses a variety of technologies and procedures to help protect your personal information from unauthorized access, use or disclosure. The personal information you provide is stored on servers that can only be accessed by authorized persons and are located in secure facilities. When you transmit sensitive data or information (e.g. credit card number) from the Internet, you are on the website of a bank or payment processor that uses encryption, theSecurity Socket Layer(SSL) protocol.
ACCOUNTABILITY
The information published on the proticket.si website is of an informative and promotional nature. Proevent d.o.o. assumes responsibility for the completeness, correctness and timeliness of this information. Photographs, multimedia content, documents and descriptions guarantee the ownership of the event.
